Guardianship
When a person becomes incapacitated and is no longer able to make their own financial or personal decisions, if they do not have a Power of Attorney and Health Care Surrogate or a Trust in place, they may require a Guardian be appointed in order to take care of the incapacitated person either physically or financially.
Like Probate, Guardianship is a Court Process and requires an analysis of the incapacitated person to determine their needs, followed by the appointment of either a family member, friend, or professional guardian, who will be required to follow procedures to document their care and handling of especially the finances of the incapacitated person. Also like Probate, this can be a very stressful process if incorrectly handled, so my goal is to work towards the best situation for the incapacitated person in a way that minimizes stress and family discord.
